We are committed to protecting your privacy and providing a secure and enjoyable online experience. This Privacy Policy governs the manner in which we collect, use, maintain, and disclose information collected from users (each, a "User") of the  product website ("Site").

Scope & Acceptance

These Terms govern use of our website, campaign microsites, and services (AI receipt validation, automated rules/draws, rewards, dashboards, chatbot). By accessing or using them, you agree to these Terms and our Privacy Policy.

Services

We provide: (a) promotion hosting; (b) AI-assisted receipt parsing & eligibility checks; (c) automated draws & rewards; (d) analytics; (e) support. Features may change or vary by plan.

Accounts & Eligibility

You’re responsible for the accuracy of info you provide and for keeping access credentials secure. Promotions may have their own rules (eligibility, dates, prizes); those specific rules prevail where they differ.

Receipt Uploads & Validation

You must upload your own original receipt image(s). We may refuse entries that are unreadable, altered, duplicated, out-of-period, wrong retailer, or otherwise ineligible. Automated decisions are used for speed and fairness; you can request review via support.

Draws & Rewards

Draws follow pre-programmed randomization and are auditable. Rewards (e.g., coupons) may have limits, expiry, and partner terms. We may substitute equivalent prizes if needed. Taxes or reporting duties (if any) are your responsibility unless stated otherwise.

Fees & Billing (for business clients)

Paid plans are billed as agreed (monthly/annually). Unpaid or disputed invoices may pause service. Unless stated, fees exclude taxes. You’re responsible for carrier/SMS/email costs with your providers.

Data & Privacy

We process personal data as described in our Privacy Policy (consent, minimization, retention, rights). Where we act as processor for brand clients, they are the controllers for their campaigns. See Privacy Policy for details.

Intellectual Property

Site content, software, and brand assets are owned by Tactiva or licensors. You receive a limited, revocable right to use our services as intended. Do not copy, modify, or distribute without permission.

Third-Party Services

We rely on trusted providers (e.g., hosting, SMS/email, analytics). Their service terms may apply at points of use. We are not liable for outages or acts of third parties beyond our reasonable control.

Disclaimers

Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation. To the fullest extent permitted by law, implied warranties are disclaimed.

Limitation of Liability

To the extent allowed by law, Tactiva is not liable for indirect, incidental, special, or consequential damages, loss of profits/revenue/data, or business interruption. Our aggregate liability for claims relating to the services is limited to the fees you paid to us in the 12 months before the event giving rise to liability.

Indemnity

You agree to indemnify and hold Tactiva harmless from claims arising out of your misuse of the services, violation of these Terms, or infringement of third-party rights.

Suspension & Termination

We may suspend or terminate access for suspected fraud, abuse, legal risk, or non-payment (business clients). You may stop using the services at any time; certain clauses survive termination (IP, limits, indemnity, governing law).

Governing Law & Disputes

These Terms are governed by Romanian law. Courts of Cluj-Napoca have exclusive jurisdiction, unless mandatory consumer law provides otherwise. For business clients, disputes may first be escalated to management; failing that, courts apply.
